After an appeal is filed

Hearing scheduling and notice

Once an appeal is filed with the Board, the hearing will be scheduled within 30 days. The Board will give at least five days written notice of the hearing. The notice will include the date and time of the hearing.

Adjournment requests

If you are unable to attend the scheduled date and time of a Board hearing or if you need more time to prepare, you may request an adjournment. Make such a request as soon as possible, in writing to the Board's office, and include the reason. A verbal request can also be made at the time of the hearing.

Adjournments are not guaranteed. They will be evaluated at the beginning of the hearing. You should arrange to have someone attend on your behalf, if you are not able to be there in case the request is denied and the hearing proceeds. The Board considers each request individually and will take into consideration the impact of all parties involved.

Withdrawal of an appeal

If you intend to withdraw your appeal, notice in writing should be submitted to the Board’s office as soon as possible. Your co-operation will prevent any delays and will help the Board work more efficiently.

Refund of appeal fee

If you withdraw your appeal prior to the commencement of the hearing, the appeal fee will be refunded. If you withdraw your appeal after the hearing has commenced, your appeal fee may be refunded at the discretion of the Board.
