Alberta Environment and Protected Areas’ Guide to Excluding the Domestic Use Aquifer (DUA) based on Municipal Bylaws

The Alberta Environment & Protected Areas (EPA) Guide to Excluding the Domestic Use Aquifer (DUA) based on Municipal Bylaws (Guide, 2022) requires confirmation from the municipality that there are bylaws in place that meet the requirements outlined in the Guide. The municipal bylaw confirmation component is set out in Section 4.

A review has determined that The City of Calgary’s Water Utility Bylaw (40M2006) meets the criteria set out in the Guide and The City of Calgary will accept applications for municipal bylaw confirmation.

Below are answers to some of the most commonly asked questions:

How do I obtain municipal bylaw confirmation from The City of Calgary?

Applicants are required to submit a completed site-specific Request for
Municipal Bylaw Confirmation form.

What information must be included in the municipal bylaw confirmation application?

Applicants are required to provide the following information:

  • Site address and confirmation that the site property boundary is greater than 300 m inside The City of Calgary’s incorporated boundary.
  • Site owner/person responsible (Representative and Company).
  • Environmental consultant (Representative and Company).
  • Summary of site conditions.
  • Reason(s) the site is being submitted for confirmation of the municipal bylaw.
  • Site figure(s) showing:
    • Current sampling information for soil and groundwater.
    • Summary showing current understanding of the conceptual site model and summary of the current understanding of any contamination (including aerial extent of heavily impacted media) or contaminant plume associated with the site.
    • A water well records search of, but not limited to, the most recent version of the Government of Alberta Water Well Information Database and a figure of the 300 m water well search radius of the source site.

All applications must be prepared by and properly authenticated by a qualified professional.

Applications that do not include or do not meet all the above noted requirements will be deemed incomplete and will not be processed. The applicant will be notified accordingly.

How do I submit a completed municipal bylaw confirmation application?

What information does The City of Calgary review?

Applications are reviewed on a site-by-site basis. As part of the application review, The City of Calgary will consider the following:

  • Potential conflicts with existing contamination risk management plans within 300 m of the applicant’s site.
  • The availability of a connection to The City of Calgary’s water system to the applicant’s site.
  • The existence of known groundwater users or alternate sources of water within 300 m of the applicant’s site.
  • Location of the applicant’s site in proximity to a source water protection area.

How long does The City’s municipal bylaw confirmation application review take?

The time required to review an application is workload and site dependent. At a minimum, The City of Calgary will meet the 60 day time limit set out in the Guide.

Is there a fee to process a municipal bylaw confirmation application?

There is no fee associated with this service.
