Seasonal patio permits
Seasonal patio permits are for businesses who want to use public land to create or expand their patios during the spring/summer. Businesses can also apply for other types of patio applications, including permanent patios on public property.

There are three styles of seasonal patios you can apply for:
Patio on a partial sidewalk
Patio on a partial sidewalk
- A patio is permitted on a sidewalk if there is 2 metres minimum clear, continuous and straight pedestrian path of travel.
Your detailed drawing should include:
- Indicate the width of existing sidewalk and surface material (concrete, grass, pavement, etc.), and dimensions of the proposed patio area. Show the 2 metres minimum clear, continuous and straight walking space on the sidewalk.
- Location and details of exits (exit width, hardware, etc.) with measurements.
- Location of tables and chairs within the patio area.
- Dimensions of proposed patio relative to the edge of the building property.
- Distance between the nearest edge along the proposed patio and the nearest edge of any above-ground obstruction and other utility poles, manholes, parking pay machines, trees, hydrants, etc.
- Elevation drawing and design of the fencing that will be used to enclose the proposed seasonal patio.
- Details of location of umbrellas and planters, if applicable.

- A patio is permitted to be in the parking lane on the road, adjacent to the curb.
- Curbside/parking lane patios shall not be permitted in any portion of a driving/travel lane or bike lane.
- Curbside patios must maintain a minimum of 2 metres of clearance from other adjacent patios, if extending beyond two parking spaces (beyond approximately 12 metres).
- A business with a curbside patio must begin and end the patio a minimum of 0.5 metres from the extension of the property line.
- Location and details of exits (exit width, hardware, etc.) with measurements.
- Location of tables and chairs within the patio area.
- Elevation (sideview) depicting the height of objects and platforms for the patio relative to existing ground.
- Dimensions of proposed patio relative to the edge of the building property.
- Distance between the nearest edge along the proposed patio and the nearest edge of any above-ground obstruction and other utility poles, manholes, parking pay machines, trees, hydrants, etc.
- Location of any driveways and street intersections near the proposed patio area.
- Show width of existing sidewalk and indicate sidewalk surface material (grass, concrete, etc.).
- Elevation drawing and design of the fencing that will be used to enclose the proposed seasonal patio.
- Details of location of umbrellas and planters, if applicable.
- Distance from the corner of an intersection and from pedestrian crosswalk to the nearest edge of the patio fence.

- For 2023, an at-sidewalk grade pedestrian detour in the parking lane provided adjacent to the patio is acceptable (as shown below). The design and construction of this should maintain flexibility and allow for a potential seamless continuation of this detour to an adjacent patio that has a similar pedestrian detour or provides clear access back onto the sidewalk.
- The extent of this pedestrian detour must still be contained within the 0.5 metres from the extension of the property line unless otherwise approved by The City (with an adjacent landowner letter of support).
- Pedestrian detours shall not be permitted in any portion of a driving/travel lane or bike lane.
Your detailed drawing should include:
- Drawings of a sidewalk grade pedestrian detour build in the parking lane (Boardwalk) and adjacent to the patio. The design and construction of the pedestrian detours must provides clear access back onto the sidewalk.
- Mark the location and details of exits and entrance to the pedestrian detours (exit width, hardware, etc.) with measurements.
- Location of tables and chairs within the patio area.
- Elevation (sideview) depicting the height of objects and platforms for the pedestrian detour relative to existing ground. (see page 9 for detailed inset).
- Dimensions of proposed patio.
- Distance between the nearest edge along the proposed patio and the nearest edge of any above-ground obstruction and other utility poles, manholes, parking pay machines, trees, hydrants, etc.
- Location of any driveways and street intersections near the proposed pedestrian detour (if applicable).
- Show width of pedestrian detour (minimum 2 metres width).
- Elevation drawing and design of the fencing that will be used to enclose the proposed seasonal patio.
- Details of location of umbrellas and planters, if applicable.
- Distance from the corner of an intersection and from pedestrian crosswalk to the nearest edge of the pedestrian detour.

Costs
Seasonal patio fees have been waived by City Council for 2025 & 2026.
Timelines
The Seasonal Patio Program typically runs from mid-May to mid-October. Please submit your application as early as possible.
